Busy medical practices understand that each day personal health information is transmitted in various forms between hospitals, doctors, attorneys, insurance companies, patients and their lawyers and families. With increasing reliance on electronic medical records health information can be transmitted with minimal effort. However, health information requests become more confusing and less streamlined when dealing with a deceased or incapacitated patient. Under what authority do you have to release patient information pertaining to a deceased individual? Do family members have the right to authorize the release of records to third-parties? This live webinar will educate you on how to identify a valid power of attorney to determine whether information should be disclosed. Additional discussions will be held on other issues surrounding access to patient health information such as health care proxies and subpoenas. You need to understand the nuances of patient information requests and the authority you can rely on when turning over patient health information.

Because your organization can never be greater than the sum of its parts, your success is determined by one key decision: who gets hired? Yet fewer than 30 percent of hiring managers nationwide have had any real training in applicant interviewing skills, a fact supported by a University of Chicago research study concluding that basing a hiring decision on an interview is only 8% more successful than if you had just flipped a coin.

Exacerbating the situation old school behavioral interviewing techniques are no longer effective because, in today’s world, the applicants are by far better prepared to answer these predictable questions than the interviewer is prepared to conduct the interview.

Attend this live webinar to take yourself to the next level and ensure that what you see is what you get. No matter what your level of expertise is, you won’t want to miss this new and effective approach to interviewing.

Understanding the Basic Pitfalls of GMP Contracting

September 10, 2013
1:00 pm ET (12:00 pm CT, 11:00 am MT, 10:00 am PT)
1 hour 30 minutes

As owners search for project delivery systems that reduce the duration from project conception to project completion one of the most common approaches has included the use of guaranteed maximum price, or GMP, contracts. However, as the use of these contract formats has proliferated so have disputes that strongly suggest that the parties using them do not fully understand: the differences between GMP contracts and the contracts that the users are used to working under, or the risks that are inherent to this delivery system.

This live webinar will highlight basic differences and alert you to the unique risks of using this format. Mr. Burnham will draw and share from his many years of hands-on experience in the negotiation, drafting and administration of GMP contracts. Topics will include in-depth description and analysis of the advantages and disadvantages of this contracting format, the four phases of work that are typical when working under a GMP format, the components of a GMP and why it is so important to fully understand how each is defined, and the conditions that apply to the payment of each component. He will discuss what to do and not do during each of these phases, including administrative burdens placed on each of the parties when using this contracting format, what a change is under a GMP contract, and how it differs from changes under other contracts.

Business Associate Obligations and Agreements after HIPAA Omnibus Rule

September 10, 2013
1:00 pm ET (12:00 pm CT, 11:00 am MT, 10:00 am PT)
1 hour 30 minutes

The development of HIPAA Business Associate Agreement (BAA) forms and practices preceded the publication of the 2013 Omnibus Final Rule that implements HIPAA and HITECH. Relationships between covered entities and their business associates, relationships among business associates, and the BAAs among them, must be updated to comply with the new rule. Potentially complicating that process, when negotiating BAAs, HIPAA covered entities frequently overreach by including topics unrelated to the business associate’s obligations under HIPAA and imposing unnecessarily complex and onerous terms. The Omnibus Final Rule, has changed and expanded business associates responsibilities. This live webinar helps persons responsible for BAA contracting to understand the proper format and scope of a BAA, address issues related to the obligations of the BA’s subcontractors and develop streamlined forms and policies and procedures for operationalizing their updated BAA.

CUSTOMER SERVICE

It’s Called a ‘Customer Return’ Policy For a Reason- WOW Them Instead of Why Them

September 17, 2013
1:00 pm ET (12 pm CT, 11 am MT, 10 am PT)
1 hour 30 minutes

Store returns are a fact of retail life. No matter what you sell, people will want to return things.

You want customers to return? Your customer return policy should have one goal: to get the customer to return.

WOW them instead of why them.

When was the last time you received exceptional service? Can you remember the last time you returned a product and didn’t have to answer lots of questions? When was the last time you were delighted by a company going beyond your expectation and made you feel special? When was the last time you had a WOW experience?

A great customer return policy is Wondrous – Outstanding – Worry-Free.

Make the return process straightforward and simple, and turn it into a WOW experience rather than an unfriendly process, and you will not only keep customers but also encourage them to spread positive word-of-mouth about your business – a truly positive bottom line.

What is the right return policy? If your goal is to bring the customer back, it’s simple: give them what they want. WOW them. Problem is that many companies need to eliminate the inquisition, endless questions, reasons for the return, etc. Treat them like appreciating assets. It costs 91% to attract a new customer than to retain an existing one (Wall Street Journal survey).
